### sec.390B Particular dealing with prescribed land This section applies if the chief executive of the department under which the Transport Infrastructure Act 1994 is administered applies for the issue of a deed of grant for a part of prescribed land. If the Governor in Council issues the deed of grant for the part of the prescribed land— the deed of grant takes effect on the day it is registered; and the lot the subject of the deed of grant stops being lease land under the perpetual lease for the prescribed land when the deed of grant is registered; and the registrar of titles must amend the leasehold land register to show the particulars of the perpetual lease after the deed of grant is issued. The deed of grant is subject to the registered interests affecting the lot before its issue. In this section— busway land means land declared as busway land under the Transport Infrastructure Act 1994 , chapter 9 . light rail land means land declared as light rail land under the Transport Infrastructure Act 1994 , chapter 10 . prescribed land means— busway land; or light rail land; or rail land. s 390B ins 2007 No. 19 s 181 amd 2010 No. 19 s 164 ; 2021 No. 12 s 148 sch 3 (sec.390B-ssec.1) This section applies if the chief executive of the department under which the Transport Infrastructure Act 1994 is administered applies for the issue of a deed of grant for a part of prescribed land.
