### sec.38A Applying for additional purpose, amalgamation or cancellation
The trustee (the applicant ) of a deed of grant in trust may apply—
for an additional purpose to be notified under section 35 ; or
to amalgamate land with common purposes under section 36 .
A person (also the applicant ) may apply for the cancellation of a deed of grant in trust under section 38 .
However, before applying under this section, the applicant must give notice of the applicant’s intention to apply to each of the following—
the trustee of the deed of grant in trust, other than the applicant;
each person with a registered interest in the trust land.
The applicant may also give notice to any other person the applicant considers has an interest in the trust land.

(sec.38A-ssec.1) The trustee (the applicant ) of a deed of grant in trust may apply— for an additional purpose to be notified under section 35 ; or to amalgamate land with common purposes under section 36 .
(sec.38A-ssec.2) A person (also the applicant ) may apply for the cancellation of a deed of grant in trust under section 38 .
(sec.38A-ssec.3) However, before applying under this section, the applicant must give notice of the applicant’s intention to apply to each of the following— the trustee of the deed of grant in trust, other than the applicant; each person with a registered interest in the trust land.
(sec.38A-ssec.4) The applicant may also give notice to any other person the applicant considers has an interest in the trust land.
- (a) for an additional purpose to be notified under section 35 ; or
- (b) to amalgamate land with common purposes under section 36 .
- (a) the trustee of the deed of grant in trust, other than the applicant;
- (b) each person with a registered interest in the trust land.
