### sec.34P Subdivision of DOGIT land
DOGIT land may be subdivided by registration of a plan of subdivision creating 2 or more lots.
The plan of subdivision may be registered only with the approval of the Minister.
Subsection (2) does not apply to a plan of subdivision that is—
for DOGIT land under the Aboriginal Land Act 1991 or the Torres Strait Islander Land Act 1991 ; or
only for the purposes of the resumption, taking or other compulsory acquisition under an Act of part of the DOGIT land.
A plan of subdivision for DOGIT land lodged for registration in the freehold land register must be accompanied by an instrument of covenant ensuring the lots created by the plan, other than any exempt lot, are held by the same person.
The covenantee under the instrument creating the covenant must be the State.
In this section—
DOGIT land means land contained in a deed of grant in trust.
exempt lot means—
land dedicated to public use under the plan; or
land resumed, taken or otherwise compulsorily acquired under an Act; or
land surrendered under section 55 .

(sec.34P-ssec.1) DOGIT land may be subdivided by registration of a plan of subdivision creating 2 or more lots.
(sec.34P-ssec.2) The plan of subdivision may be registered only with the approval of the Minister.
(sec.34P-ssec.3) Subsection (2) does not apply to a plan of subdivision that is— for DOGIT land under the Aboriginal Land Act 1991 or the Torres Strait Islander Land Act 1991 ; or only for the purposes of the resumption, taking or other compulsory acquisition under an Act of part of the DOGIT land.
