### sec.295 Right to have interest registered
If a person lodges a document transferring or creating an interest in land under this Act, the registrar of titles must register the document if—
the document has been correctly executed; and
the person lodges the document and all other documents needed by the registrar to effect registration of the document; and
the document appears on its face to be capable of registration; and
the person has otherwise complied with this Act for the registration of the document; and
the document is not inconsistent with another Act or law; and
if the document is a plan of survey—it is not inconsistent with another plan of survey.
If the document is a plan of survey and it is inconsistent with another plan of survey, the registrar of titles may—
give a notice to a person holding an interest in a lot that may be affected by registration of the plan of survey; or
require the person who lodged the document to give a notice, in the way the registrar requires, to a person mentioned in paragraph (a) .
However, subsection (1) does not prevent the person from withdrawing the document before it is registered.

(sec.295-ssec.2) If the document is a plan of survey and it is inconsistent with another plan of survey, the registrar of titles may— give a notice to a person holding an interest in a lot that may be affected by registration of the plan of survey; or require the person who lodged the document to give a notice, in the way the registrar requires, to a person mentioned in paragraph (a) .
(sec.295-ssec.3) However, subsection (1) does not prevent the person from withdrawing the document before it is registered.
- (a) the document has been correctly executed; and
- (b) the person lodges the document and all other documents needed by the registrar to effect registration of the document; and
- (c) the document appears on its face to be capable of registration; and
- (d) the person has otherwise complied with this Act for the registration of the document; and
- (e) the document is not inconsistent with another Act or law; and
- (f) if the document is a plan of survey—it is not inconsistent with another plan of survey.
- (a) give a notice to a person holding an interest in a lot that may be affected by registration of the plan of survey; or
- (b) require the person who lodged the document to give a notice, in the way the registrar requires, to a person mentioned in paragraph (a) .
