### sec.294B Building management statement may be registered A building management statement may be registered. A building management statement is a document that— identifies lots to which it applies; and contains provisions benefiting and burdening the lots to which it applies; and otherwise complies with the requirements of this division for a building management statement. Each lot to which a building management statement applies must be a lot entirely or partly contained in, or entirely or partly containing, 1 or more buildings. However, a building management statement that otherwise complies with subsection (3) may also apply to a lot that is not entirely or partly contained in, and does not entirely or partly contain, 1 or more buildings if the lot is the subject of a building development approval. If a lot to which a building management statement applies is the subject of a plan of subdivision, the statement applies to each lot created by the registration of the plan. However, the registration of a building management statement does not limit anything the designated person may do, or the registrar of titles must do, under section 360 or 360A . In this section— building development approval means a development approval under the Planning Act for development relating to a proposed building or buildings. s 294B ins 2004 No. 9 s 77 amd 2005 No. 68 s 24 ; 2007 No. 19 s 146 ; 2009 No. 36 s 872 sch 2 ; 2016 No. 27 s 281 ; 2021 No. 12 s 148 sch 3 (sec.294B-ssec.1) A building management statement may be registered. (sec.294B-ssec.2) A building management statement is a document that— identifies lots to which it applies; and contains provisions benefiting and burdening the lots to which it applies; and otherwise complies with the requirements of this division for a building management statement. (sec.294B-ssec.3) Each lot to which a building management statement applies must be a lot entirely or partly contained in, or entirely or partly containing, 1 or more buildings. (sec.294B-ssec.4) However, a building management statement that otherwise complies with subsection (3) may also apply to a lot that is not entirely or partly contained in, and does not entirely or partly contain, 1 or more buildings if the lot is the subject of a building development approval.
