### sec.246 Application of division This division applies to land— that has been the subject of a lease that— has been forfeited; or has been surrendered absolutely; or has expired; or that has been the subject of an occupation licence that— has been cancelled; or has been surrendered absolutely; or that has been set aside as a reserve if— the dedication of the reserve has been revoked; and the improvements on the reserve have been made by the trustee of the reserve, or by a person with the trustee’s authority; or that has been the subject of a deed of grant in trust if— the deed of grant in trust has been cancelled or surrendered absolutely; and the improvements on the land have been made by the trustee or a person with the trustee’s authority. s 246 amd 2004 No. 4 s 29 ; 2007 No. 19 s 131 - (a) that has been the subject of a lease that— (i) has been forfeited; or (ii) has been surrendered absolutely; or (iii) has expired; or - (i) has been forfeited; or - (ii) has been surrendered absolutely; or - (iii) has expired; or - (b) that has been the subject of an occupation licence that— (i) has been cancelled; or (ii) has been surrendered absolutely; or - (i) has been cancelled; or - (ii) has been surrendered absolutely; or - (c) that has been set aside as a reserve if— (i) the dedication of the reserve has been revoked; and (ii) the improvements on the reserve have been made by the trustee of the reserve, or by a person with the trustee’s authority; or - (i) the dedication of the reserve has been revoked; and - (ii) the improvements on the reserve have been made by the trustee of the reserve, or by a person with the trustee’s authority; or - (d) that has been the subject of a deed of grant in trust if— (i) the deed of grant in trust has been cancelled or surrendered absolutely; and (ii) the improvements on the land have been made by the trustee or a person with the trustee’s authority. - (i) the deed of grant in trust has been cancelled or surrendered absolutely; and - (ii) the improvements on the land have been made by the trustee or a person with the trustee’s authority. - (i) has been forfeited; or - (ii) has been surrendered absolutely; or - (iii) has expired; or - (i) has been cancelled; or - (ii) has been surrendered absolutely; or - (i) the dedication of the reserve has been revoked; and - (ii) the improvements on the reserve have been made by the trustee of the reserve, or by a person with the trustee’s authority; or - (i) the deed of grant in trust has been cancelled or surrendered absolutely; and - (ii) the improvements on the land have been made by the trustee or a person with the trustee’s authority.
