### sec.234 When lease may be forfeited
A lease may be forfeited—
if the lessee defaults in the payment of an amount payable to the State under this Act for the lease; or
A rent and instalment regulation may allow the Minister to take action for non-payment.
if the lessee breaches a condition of the lease, other than—
a condition of the lease applying under section 199B (a) or (b) ; or
a condition that the lessee comply with a land management agreement for the lease; or
A breach of a condition mentioned in subparagraph (i) or (ii) may be dealt with by a remedial action notice.
if the lessee fails to comply with a remedial action notice requiring the lessee to take remedial action to remedy a breach of a condition of the lease applying under section 199B (a) or (b) ; or
if the lessee contravenes a provision of this Act in relation to the lease; or
if the lessee is found by a court of competent jurisdiction to have acquired the lease by fraud; or
if the lessee fails to comply with a remedial action order relating to the lease.

- (a) if the lessee defaults in the payment of an amount payable to the State under this Act for the lease; or Note— A rent and instalment regulation may allow the Minister to take action for non-payment.
- (b) if the lessee breaches a condition of the lease, other than— (i) a condition of the lease applying under section 199B (a) or (b) ; or (ii) a condition that the lessee comply with a land management agreement for the lease; or Note— A breach of a condition mentioned in subparagraph (i) or (ii) may be dealt with by a remedial action notice.
- (i) a condition of the lease applying under section 199B (a) or (b) ; or
- (ii) a condition that the lessee comply with a land management agreement for the lease; or
- (c) if the lessee fails to comply with a remedial action notice requiring the lessee to take remedial action to remedy a breach of a condition of the lease applying under section 199B (a) or (b) ; or
- (d) if the lessee contravenes a provision of this Act in relation to the lease; or
- (e) if the lessee is found by a court of competent jurisdiction to have acquired the lease by fraud; or
- (f) if the lessee fails to comply with a remedial action order relating to the lease.
- (i) a condition of the lease applying under section 199B (a) or (b) ; or
- (ii) a condition that the lessee comply with a land management agreement for the lease; or
