### sec.58 Summons may be issued instead of warrant
A justice may issue a summons against a person for an indictable offence instead of issuing a warrant to apprehend the person for the offence.
Despite the issue of the summons, a justice may issue a warrant for the apprehension of the person at any time before or after the time mentioned in the summons for the person’s appearance.
