### sec.966 Accruing entitlements—leave accrued immediately before relevant day
This section applies to the following types of leave, however described, accruing to an employee (the leave )—
annual leave;
sick leave, personal leave or carer’s leave;
long service leave.
If a declared employee to whom a new State instrument applies had, immediately before the relevant day, an accrued entitlement to an amount of the leave, the accrued leave is taken to have accrued under the new State instrument.
It does not matter whether the leave accrued under the old federal instrument, under the national fair work legislation or this Act.
A regulation may deal with other matters relating to how a new State instrument applies to any other accrued entitlement that, immediately before the relevant day, a declared employee had under the old federal instrument or the Commonwealth Fair Work Act .
