### sec.90 Continuity of service
Parental leave and flexible parental leave do not break an employee’s continuity of service.
Parental leave and flexible parental leave are not to be taken into account in working out the employee’s period of service, other than—
to decide the employee’s entitlement to a later period of parental leave or a period of flexible parental leave; or
as expressly provided in—
this Act; or
an applicable industrial instrument; or
a contract of employment.
In this section—
flexible parental leave means leave an employee is entitled to under section 87B .

(sec.90-ssec.1) Parental leave and flexible parental leave do not break an employee’s continuity of service.
(sec.90-ssec.2) Parental leave and flexible parental leave are not to be taken into account in working out the employee’s period of service, other than— to decide the employee’s entitlement to a later period of parental leave or a period of flexible parental leave; or as expressly provided in— this Act; or an applicable industrial instrument; or a contract of employment.
(sec.90-ssec.3) In this section— flexible parental leave means leave an employee is entitled to under section 87B .
- (a) to decide the employee’s entitlement to a later period of parental leave or a period of flexible parental leave; or
- (b) as expressly provided in— (i) this Act; or (ii) an applicable industrial instrument; or (iii) a contract of employment.
