### sec.804 Exemption
An organisation, or 2 or more organisations jointly, may apply to the registrar for an exemption from keeping a members register or an officers register.
The registrar may grant the exemption only if satisfied the applicant has a counterpart federal body and—
for an exemption from keeping a members register—
its members are, when the application is made, recorded as members of the body in the body’s register of members under the Commonwealth Registered Organisations Act ; and
the body has complied with the requirements under the Commonwealth Registered Organisations Act about keeping its register of members and other records for its members; or
for an exemption from keeping an officers register—
its officers are all officers of the body; and
the body has complied with the requirements under the Commonwealth Registered Organisations Act about keeping and filing records for its officers.
An exemption remains in force for the period stated in it or, if no period is stated, until it is cancelled.
(sec.804-ssec.1) An organisation, or 2 or more organisations jointly, may apply to the registrar for an exemption from keeping a members register or an officers register.
(sec.804-ssec.2) The registrar may grant the exemption only if satisfied the applicant has a counterpart federal body and— for an exemption from keeping a members register— its members are, when the application is made, recorded as members of the body in the body’s register of members under the Commonwealth Registered Organisations Act ; and the body has complied with the requirements under the Commonwealth Registered Organisations Act about keeping its register of members and other records for its members; or for an exemption from keeping an officers register— its officers are all officers of the body; and the body has complied with the requirements under the Commonwealth Registered Organisations Act about keeping and filing records for its officers.
(sec.804-ssec.3) An exemption remains in force for the period stated in it or, if no period is stated, until it is cancelled.
- (a) for an exemption from keeping a members register— (i) its members are, when the application is made, recorded as members of the body in the body’s register of members under the Commonwealth Registered Organisations Act ; and (ii) the body has complied with the requirements under the Commonwealth Registered Organisations Act about keeping its register of members and other records for its members; or
- (i) its members are, when the application is made, recorded as members of the body in the body’s register of members under the Commonwealth Registered Organisations Act ; and
- (ii) the body has complied with the requirements under the Commonwealth Registered Organisations Act about keeping its register of members and other records for its members; or
- (b) for an exemption from keeping an officers register— (i) its officers are all officers of the body; and (ii) the body has complied with the requirements under the Commonwealth Registered Organisations Act about keeping and filing records for its officers.
- (i) its officers are all officers of the body; and
- (ii) the body has complied with the requirements under the Commonwealth Registered Organisations Act about keeping and filing records for its officers.
- (i) its members are, when the application is made, recorded as members of the body in the body’s register of members under the Commonwealth Registered Organisations Act ; and
- (ii) the body has complied with the requirements under the Commonwealth Registered Organisations Act about keeping its register of members and other records for its members; or
- (i) its officers are all officers of the body; and
- (ii) the body has complied with the requirements under the Commonwealth Registered Organisations Act about keeping and filing records for its officers.
