### sec.406ZJ Deciding relevant contract determination
This section applies if—
a principal contractor, organisation or federal organisation proposes to make a negotiated agreement; and
there is no relevant contract determination for some or all of the independent couriers to whom the agreement will apply.
The principal contractor, organisation or federal organisation must apply to the commission for a decision under subsection (3) .
On application, the commission must decide that a contract determination that regulates the remuneration and working conditions of independent couriers engaged in similar work as the independent couriers under the proposed agreement is appropriate for deciding whether the agreement passes the no-disadvantage test under section 406ZI .

(sec.406ZJ-ssec.1) This section applies if— a principal contractor, organisation or federal organisation proposes to make a negotiated agreement; and there is no relevant contract determination for some or all of the independent couriers to whom the agreement will apply.
(sec.406ZJ-ssec.2) The principal contractor, organisation or federal organisation must apply to the commission for a decision under subsection (3) .
