### sec.271 Right to refuse work if imminent health or safety risk This Act does not prevent an employee from refusing to perform work if— the refusal is based on a reasonable concern by the employee about an imminent risk to the employee’s health or safety; and the employee does not unreasonably contravene a direction of the employee’s employer to perform other available work (whether at the same or another workplace) that is safe and appropriate for the employee to perform. s 271 amd 2022 No. 27 s 3 sch 1 - (a) the refusal is based on a reasonable concern by the employee about an imminent risk to the employee’s health or safety; and - (b) the employee does not unreasonably contravene a direction of the employee’s employer to perform other available work (whether at the same or another workplace) that is safe and appropriate for the employee to perform.
