### sec.165 Who may make certified agreements
A certified agreement may be made between—
an employer; and
either—
1 or more employee organisations that represent, or are entitled to represent, any employees of the employer who are, or are eligible to be, members of the organisation; or
if subparagraph (i) does not apply, the employees of the employer at the time the agreement is made.
(sec.165-ssec) A certified agreement may be made between— an employer; and either— 1 or more employee organisations that represent, or are entitled to represent, any employees of the employer who are, or are eligible to be, members of the organisation; or if subparagraph (i) does not apply, the employees of the employer at the time the agreement is made.
- (a) an employer; and
- (b) either— (i) 1 or more employee organisations that represent, or are entitled to represent, any employees of the employer who are, or are eligible to be, members of the organisation; or (ii) if subparagraph (i) does not apply, the employees of the employer at the time the agreement is made.
- (i) 1 or more employee organisations that represent, or are entitled to represent, any employees of the employer who are, or are eligible to be, members of the organisation; or
- (ii) if subparagraph (i) does not apply, the employees of the employer at the time the agreement is made.
