### sec.86 Duty of confidentiality
This section applies to a person—
who is, or has been, appointed as an authorised officer; and
who, in the course of the appointment or because of opportunity provided by the appointment, has gained or has access to confidential information about someone else.
The person must not make a record of the information, disclose the information to anyone else or give access to the information to anyone else, other than—
for a purpose of this Act; or
with the consent of the person to whom the information relates; or
in compliance with lawful process requiring production of documents or giving of evidence before a court or tribunal; or
as expressly permitted or required under an Act.
Maximum penalty—20 penalty units.
In this section—
authorised officer does not include the registrar.

(sec.86-ssec.3) In this section— authorised officer does not include the registrar.
- (a) who is, or has been, appointed as an authorised officer; and
- (b) who, in the course of the appointment or because of opportunity provided by the appointment, has gained or has access to confidential information about someone else.
- (a) for a purpose of this Act; or
- (b) with the consent of the person to whom the information relates; or
- (c) in compliance with lawful process requiring production of documents or giving of evidence before a court or tribunal; or
- (d) as expressly permitted or required under an Act.
