### sec.26 Demand for repayment of unexpended amounts
This section applies if—
a funding agreement with a funded provider ends; and
an amount that the chief executive paid to the provider under the agreement has not been expended.
The chief executive may give the provider a notice (a show cause notice ) stating—
that the chief executive proposes to demand repayment of the unexpended amount; and
that the provider may, within a stated time of at least 7 days, give the chief executive a written response about the proposed demand.
After considering any written response received from the provider within the stated time, the chief executive may demand repayment of all or some of the amount stated in the show cause notice.
If the chief executive decides not to demand repayment of any of the amount, the chief executive must give the provider notice of the decision.
The chief executive may recover the demanded amount as a debt owed to the State.
This section does not limit the ways the chief executive may demand payment of, or recover, an amount owed to the chief executive.
