### sec.99 Requirements for appointment
Before appointing persons to be members of an RCA team to conduct an RCA of a reportable event, the commissioning authority proposing to make the appointment must be satisfied that—
the persons—
have the appropriate skills, knowledge and experience to conduct an RCA of the event, having regard to the nature of the event; and
were not directly involved in providing the relevant health service; and
the potential benefit in disclosing relevant information is outweighed by the potential benefit of restricting disclosure of the information under subdivision 5 ; and
the conduct of an RCA of the event would be helped by the provision of immunities and protections provided to persons under subdivision 6 .
In this section—
relevant information means information that will be compiled by the proposed RCA team in the conduct of an RCA of the reportable event.
(sec.99-ssec.1) Before appointing persons to be members of an RCA team to conduct an RCA of a reportable event, the commissioning authority proposing to make the appointment must be satisfied that— the persons— have the appropriate skills, knowledge and experience to conduct an RCA of the event, having regard to the nature of the event; and were not directly involved in providing the relevant health service; and the potential benefit in disclosing relevant information is outweighed by the potential benefit of restricting disclosure of the information under subdivision 5 ; and the conduct of an RCA of the event would be helped by the provision of immunities and protections provided to persons under subdivision 6 .
(sec.99-ssec.2) In this section— relevant information means information that will be compiled by the proposed RCA team in the conduct of an RCA of the reportable event.
- (a) the persons— (i) have the appropriate skills, knowledge and experience to conduct an RCA of the event, having regard to the nature of the event; and (ii) were not directly involved in providing the relevant health service; and
- (i) have the appropriate skills, knowledge and experience to conduct an RCA of the event, having regard to the nature of the event; and
- (ii) were not directly involved in providing the relevant health service; and
- (b) the potential benefit in disclosing relevant information is outweighed by the potential benefit of restricting disclosure of the information under subdivision 5 ; and
- (c) the conduct of an RCA of the event would be helped by the provision of immunities and protections provided to persons under subdivision 6 .
- (i) have the appropriate skills, knowledge and experience to conduct an RCA of the event, having regard to the nature of the event; and
- (ii) were not directly involved in providing the relevant health service; and
