### sec.79 Entitlement on ending of particular employment contracts This section applies if— a health service employee is employed on contract other than as a health executive or a senior health service employee; and the contract— is terminated other than by disciplinary action; or expires and is not renewed or replaced by another contract of employment as a health service employee other than as a health executive or a senior health service employee; and when the employee was first employed under the contract, or an earlier continuous contract of employment as a health service employee other than as a health executive or a senior health service employee, the employee was employed on tenure. The employee becomes a health service employee on tenure. The employee is to be employed— at the classification level at which the employee would have been employed if the employee had continued in employment as a health service employee on tenure; and on the remuneration to which the employee would have been entitled if the employee had continued in employment as a health service employee on tenure. s 79 amd 2013 No. 61 s 98 (sec.79-ssec.1) This section applies if— a health service employee is employed on contract other than as a health executive or a senior health service employee; and the contract— is terminated other than by disciplinary action; or expires and is not renewed or replaced by another contract of employment as a health service employee other than as a health executive or a senior health service employee; and when the employee was first employed under the contract, or an earlier continuous contract of employment as a health service employee other than as a health executive or a senior health service employee, the employee was employed on tenure. (sec.79-ssec.2) The employee becomes a health service employee on tenure. (sec.79-ssec.3) The employee is to be employed— at the classification level at which the employee would have been employed if the employee had continued in employment as a health service employee on tenure; and on the remuneration to which the employee would have been entitled if the employee had continued in employment as a health service employee on tenure. - (a) a health service employee is employed on contract other than as a health executive or a senior health service employee; and - (b) the contract— (i) is terminated other than by disciplinary action; or (ii) expires and is not renewed or replaced by another contract of employment as a health service employee other than as a health executive or a senior health service employee; and - (i) is terminated other than by disciplinary action; or - (ii) expires and is not renewed or replaced by another contract of employment as a health service employee other than as a health executive or a senior health service employee; and - (c) when the employee was first employed under the contract, or an earlier continuous contract of employment as a health service employee other than as a health executive or a senior health service employee, the employee was employed on tenure. - (i) is terminated other than by disciplinary action; or - (ii) expires and is not renewed or replaced by another contract of employment as a health service employee other than as a health executive or a senior health service employee; and - (a) at the classification level at which the employee would have been employed if the employee had continued in employment as a health service employee on tenure; and - (b) on the remuneration to which the employee would have been entitled if the employee had continued in employment as a health service employee on tenure.
