### sec.197 Duty of confidentiality of health service investigators
This section applies to a person who—
is or has been a health service investigator; and
in that capacity was given information.
The person must not disclose the information to anyone else.
Maximum penalty—100 penalty units.
However, the person may disclose the information to someone else—
to the extent necessary to perform the person’s functions under or in relation to this Act; or
if the person to whom the information relates consents in writing to the disclosure; or
if the disclosure is otherwise required or permitted by another Act or law.
Also, the person may disclose the information to someone else if—
the disclosure is to—
the relevant chief executive; or
another person authorised in writing by the relevant chief executive to receive the information; and
the purpose of the disclosure under this section is to allow further disclosure of the information under section 160 .

(sec.197-ssec.4) Also, the person may disclose the information to someone else if— the disclosure is to— the relevant chief executive; or another person authorised in writing by the relevant chief executive to receive the information; and the purpose of the disclosure under this section is to allow further disclosure of the information under section 160 .
- (a) is or has been a health service investigator; and
- (b) in that capacity was given information.
- (a) to the extent necessary to perform the person’s functions under or in relation to this Act; or
- (b) if the person to whom the information relates consents in writing to the disclosure; or
- (c) if the disclosure is otherwise required or permitted by another Act or law.
- (a) the disclosure is to— (i) the relevant chief executive; or (ii) another person authorised in writing by the relevant chief executive to receive the information; and
- (i) the relevant chief executive; or
- (ii) another person authorised in writing by the relevant chief executive to receive the information; and
- (b) the purpose of the disclosure under this section is to allow further disclosure of the information under section 160 .
- (i) the relevant chief executive; or
- (ii) another person authorised in writing by the relevant chief executive to receive the information; and
