### sec.89 Safety requirement
A person must not use, or permit to be used, on a road a heavy vehicle that is unsafe.
Maximum penalty—$6000.
For the purposes of subsection (1) , a heavy vehicle is unsafe only if the condition of the vehicle, or any of its components or equipment—
makes the use of the vehicle unsafe; or
endangers public safety.
Subsection (1) does not apply to a heavy vehicle for which a vehicle defect notice is in force and that is being moved in accordance with the terms of the notice.
