### sec.728 Duty of confidentiality for protected information
A person who is, or has been, a person exercising functions under this Law must not disclose protected information to another person.
Maximum penalty—$20000.
However, subsection (1) does not apply to the Regulator—
disclosing protected information in the form of a confirmation that a stated person is the registered operator of a stated heavy vehicle; or
disclosing details of heavy vehicles registered in a person’s name to an executor or administrator of that person’s deceased estate.
Also, subsection (1) does not apply if—
the disclosure is to an entity for an authorised use; or
the disclosure is to, or made with the agreement of, the person to whom the information relates.
