### sec.324 Record keeper must give information from electronic work diary
This section applies if—
the driver of a fatigue-regulated heavy vehicle is required to record information in the driver’s work diary under Division 2 ; and
the driver’s record keeper is a person other than the driver; and
the driver is using an electronic work diary supplied to the driver by the driver’s record keeper.
If the driver stops using the electronic work diary, the driver’s record keeper must immediately give the driver, in a way that makes the information readily available to the driver, the information recorded in the work diary for each day on which the driver was using the electronic work diary, unless the record keeper has a reasonable excuse.
Maximum penalty—$3000.
If the record keeper has engaged another person under a contract for services to comply with subsection (2) for the record keeper—
the record keeper remains liable for an offence against subsection (2) ; and
the other person is also liable for an offence against subsection (2) as if the other person were the record keeper mentioned in the subsection.
