What it does
The Health Legislation Administration Act 1984 (WA) establishes an administrative framework for the coordination and delivery of health and related services in Western Australia by setting personnel, delegation, financial and advisory arrangements for the Department that principally assists the Minister in administering health Acts. It applies to those Acts whose administration the Governor has committed to the Minister (s 4). Key mechanical effects are:
- It requires that officers necessary to carry out the provisions of those Acts be appointed in the Department under Part 3 of the Public Sector Management Act 1994 (s 6(1)).
- It authorises the Minister to appoint or engage, for the purposes of the Acts to which the Act applies (with a statutory exception), persons who are not public service officers as employees or contractors and to determine their terms after consulting the Public Sector Commissioner (s 6(2)-(3)).
- It confers full operational effect on appointments made under s 6: an appointee may exercise and must carry out the powers and duties attached to the appointment, and orders or directions given by such a person have effect (s 8).
- It creates a statutory delegation regime enabling the Minister, the CEO or a prescribed officer to delegate any power or duty conferred on them by a relevant Act, subject to procedural requirements and specified exceptions (s 9(1)-(7)).
- It makes the Department subject to the Financial Management Act 2006 and the Auditor General Act 2006 for financial administration, audit and reporting (s 10).
- It authorises the Minister to establish advisory groups, committees, councils and panels, to appoint members, and to determine remuneration after consultation with the Public Sector Commissioner (s 11).
