### sec.36 Certification of guide dogs
An approved guide dog trainer may only certify a guide dog for a person with a disability if the dog—
is able to be used as a guide by a person with disability attributable to a vision impairment; and
has passed a public access test conducted by the following within 7 days before being certified—
for an approved trainer—the trainer;
for an approved training institution—an employee trainer of the institution; and
is not a dog of a breed prohibited from importation into Australia under the Customs Act 1901 (Cwlth) ; and
is desexed and vaccinated; and
has not been declared a dangerous dog under a local law.

- (a) is able to be used as a guide by a person with disability attributable to a vision impairment; and
- (b) has passed a public access test conducted by the following within 7 days before being certified— (i) for an approved trainer—the trainer; (ii) for an approved training institution—an employee trainer of the institution; and
- (i) for an approved trainer—the trainer;
- (ii) for an approved training institution—an employee trainer of the institution; and
- (c) is not a dog of a breed prohibited from importation into Australia under the Customs Act 1901 (Cwlth) ; and
- (d) is desexed and vaccinated; and
- (e) has not been declared a dangerous dog under a local law.
- (i) for an approved trainer—the trainer;
- (ii) for an approved training institution—an employee trainer of the institution; and
