### sec.99 Restrictions on amendment
A geothermal lease holder may amend the development plan for the lease.
However, the amendment is subject to approval under this division.
Also, a development plan can not be amended—
in a way that provides for a cessation of geothermal production under a geothermal lease; or
if the plan as amended would be inconsistent with—
the mandatory conditions for geothermal leases; or
any relevant environmental condition for the lease.
(sec.99-ssec.1) A geothermal lease holder may amend the development plan for the lease.
(sec.99-ssec.2) However, the amendment is subject to approval under this division.
(sec.99-ssec.3) Also, a development plan can not be amended— in a way that provides for a cessation of geothermal production under a geothermal lease; or if the plan as amended would be inconsistent with— the mandatory conditions for geothermal leases; or any relevant environmental condition for the lease.
- (a) in a way that provides for a cessation of geothermal production under a geothermal lease; or
- (b) if the plan as amended would be inconsistent with— (i) the mandatory conditions for geothermal leases; or (ii) any relevant environmental condition for the lease.
