### sec.28 State ownership of geothermal energy
All geothermal energy on or below the surface of any land in the State is, and is taken always to have been, the property of the State.
To remove any doubt, it is declared that—
a person does not acquire any property in geothermal energy merely because the person discovers it or discovers geothermal resources from which geothermal energy may be extracted; and
subsection (1) applies whether or not the land is freehold or other land.
This section applies despite any other Act, grant, title or other document.
(sec.28-ssec.1) All geothermal energy on or below the surface of any land in the State is, and is taken always to have been, the property of the State.
