### sec.107 Confidentiality
This section applies to a person who—
is or has been a public service officer or engaged to perform functions under this Act; and
in that capacity has acquired information or has or had access to, or custody of, a document containing information relating to the administration of this chapter that is not publicly available.
This section also applies to a person to whom the Minister has disclosed information mentioned in section 105 (j) , other than the person to whom the information relates.
The person must not—
make a record of the information; or
whether directly or indirectly, disclose the information; or
use the information to benefit any person.
Maximum penalty—200 penalty units or 1 year’s imprisonment.
However, subsection (3) does not apply if the record is made, or the information is disclosed or used—
to the extent necessary to perform the person’s functions under or relating to this chapter; or
with the consent of the person to whom the information relates; or
as required or permitted by law.
