### sec.85C Decision on increase application (hours of gaming)
The commissioner may, in relation to an increase application (hours of gaming)—
approve the hours of gaming sought by the applicant; or
approve an increase that differs from the increase sought by the applicant; or
refuse to approve an increase to the hours of gaming for the licensed premises.
In making the decision, the commissioner must have regard to the matters the commissioner had regard to in considering the increase application under section 85B .
The commissioner may refuse to approve an increase if the applicant, without a reasonable excuse, fails to comply with a requirement of the commissioner under section 85B (2) .
If the commissioner approves an increase as sought by the licensee, the commissioner must immediately give written notice of the decision to the licensee.
If the commissioner refuses to approve an increase, or approves an increase that differs from the increase sought in the application, the commissioner must immediately give the licensee an information notice for the decision.

(sec.85C-ssec.3) The commissioner may refuse to approve an increase if the applicant, without a reasonable excuse, fails to comply with a requirement of the commissioner under section 85B (2) .
(sec.85C-ssec.4) If the commissioner approves an increase as sought by the licensee, the commissioner must immediately give written notice of the decision to the licensee.
(sec.85C-ssec.5) If the commissioner refuses to approve an increase, or approves an increase that differs from the increase sought in the application, the commissioner must immediately give the licensee an information notice for the decision.
- (a) approve the hours of gaming sought by the applicant; or
- (b) approve an increase that differs from the increase sought by the applicant; or
- (c) refuse to approve an increase to the hours of gaming for the licensed premises.
