### sec.456 Protection from liability
This section applies to the following applications received by the chief executive on or after 16 April 2008 and before the commencement of the Gambling and Other Legislation Amendment Act 2009 , section 41 —
an application under section 56 for a category 2 licence;
an application under section 61 for approval of premises as additional premises to which a category 2 licence relates;
an application under section 81 to have the approved number of gaming machines for category 2 licensed premises increased.
The State, a departmental officer or a commissioner does not incur civil liability for acting or failing to act in relation to the application.
If a civil proceeding relating to the application was started before the commencement day against the State, a departmental officer or a commissioner, the proceeding is stayed and the court dealing with the proceeding must dismiss it.
In this section—
commencement day means the day this section commences.
