### sec.439 Obligation of licensed gaming nominee
This section applies to a person who was the holder of a gaming nominee’s licence in force under this Act immediately before the commencement.
The holder must, before 31 December 2005, give the chief executive evidence that the chief executive considers on reasonable grounds shows the holder has successfully completed an approved training course.
However, subsection (2) does not apply to the holder if—
for at least 1 year immediately before the commencement, the holder—
was a licensed gaming nominee; and
was employed as a nominee of a licensee for licensed premises; and
before 31 December 2005, the holder gives the chief executive evidence that the chief executive considers on reasonable grounds shows the holder has, within 3 years before the commencement, successfully completed each of the following units of competency from the Hospitality (THH02) training package endorsed by ANTA—
THHADG01B (Analyse and report on gaming machine data);
THHADG02A (Develop and manage gaming activities);
THHADG03B (Provide responsible gambling services);
THHBG01B (Attend gaming machines).

(sec.439-ssec.1) This section applies to a person who was the holder of a gaming nominee’s licence in force under this Act immediately before the commencement.
(sec.439-ssec.2) The holder must, before 31 December 2005, give the chief executive evidence that the chief executive considers on reasonable grounds shows the holder has successfully completed an approved training course.
(sec.439-ssec.3) However, subsection (2) does not apply to the holder if— for at least 1 year immediately before the commencement, the holder— was a licensed gaming nominee; and was employed as a nominee of a licensee for licensed premises; and before 31 December 2005, the holder gives the chief executive evidence that the chief executive considers on reasonable grounds shows the holder has, within 3 years before the commencement, successfully completed each of the following units of competency from the Hospitality (THH02) training package endorsed by ANTA— THHADG01B (Analyse and report on gaming machine data); THHADG02A (Develop and manage gaming activities); THHADG03B (Provide responsible gambling services); THHBG01B (Attend gaming machines).
- (a) for at least 1 year immediately before the commencement, the holder— (i) was a licensed gaming nominee; and (ii) was employed as a nominee of a licensee for licensed premises; and
- (i) was a licensed gaming nominee; and
- (ii) was employed as a nominee of a licensee for licensed premises; and
- (b) before 31 December 2005, the holder gives the chief executive evidence that the chief executive considers on reasonable grounds shows the holder has, within 3 years before the commencement, successfully completed each of the following units of competency from the Hospitality (THH02) training package endorsed by ANTA— (i) THHADG01B (Analyse and report on gaming machine data); (ii) THHADG02A (Develop and manage gaming activities); (iii) THHADG03B (Provide responsible gambling services); (iv) THHBG01B (Attend gaming machines).
- (i) THHADG01B (Analyse and report on gaming machine data);
- (ii) THHADG02A (Develop and manage gaming activities);
- (iii) THHADG03B (Provide responsible gambling services);
- (iv) THHBG01B (Attend gaming machines).
- (i) was a licensed gaming nominee; and
- (ii) was employed as a nominee of a licensee for licensed premises; and
- (i) THHADG01B (Analyse and report on gaming machine data);
- (ii) THHADG02A (Develop and manage gaming activities);
- (iii) THHADG03B (Provide responsible gambling services);
- (iv) THHBG01B (Attend gaming machines).
