### sec.340 Prohibition on control of applications by category 2 licensees
A person must not have or gain—
control over, or the ability to control, an application or the content of an application by a category 2 licensee under part 3 , whether or not the licensee makes an application under the part; or
the ability to interpose between a category 2 licensee and the commissioner in respect to an application made by the licensee under part 3 ;
unless the person is the secretary, an executive officer or a member of the licensee carrying out the duties or exercising the normal rights that person has as such secretary, executive officer or member.
Maximum penalty—200 penalty units.
