### sec.290 Gaming prohibited on unprotected devices
A licensee must not without lawful excuse be in possession of or permit gaming on a gaming machine unless the computer cabinet and site controller of the gaming machine are securely sealed with a seal affixed by—
an inspector; or
a licensed repairer acting under this Act; or
a person properly authorised in that behalf under section 292 (4) .
Maximum penalty—1,000 penalty units or 5 years imprisonment.
Subject to subsection (3) , at any time when a seal on a computer cabinet or site controller of a gaming machine has been removed, broken or damaged, the licensee must not permit gaming on the gaming machine until the gaming machine or site controller has been examined by an inspector or other person properly authorised by the commissioner in that behalf and the computer cabinet or site controller has been sealed.
Maximum penalty—1,000 penalty units or 5 years imprisonment.
Subsection (2) does not apply to a gaming machine that is not available for gaming due to the gaming machine undergoing—
installation, alteration, adjustment, maintenance or repair by a licensed repairer acting under this Act; or
an alteration to effect a change of game directed by the commissioner under section 80 (1) .
