### sec.192 Certain persons must apply for key monitoring employee’s licence
If the commissioner considers a person is a key officer of a licensed monitoring operator, the commissioner must, by written notice given to the person, require the person, within 7 days after receiving the notice, either—
to apply for a key monitoring employee’s licence; or
to stop being a key officer of the operator.
The commissioner must give a copy of the notice to the licensed monitoring operator.
The person to whom the notice is given must, within 7 days after receiving the notice, comply with the requirement (the licensing requirement ) stated in the notice, unless the person has a reasonable excuse.
Maximum penalty—200 penalty units.
If the person fails to comply with the licensing requirement, the commissioner must give written notice of the failure to the licensed monitoring operator.
The licensed monitoring operator must, immediately on receipt of the notice under subsection (4) , end the association with, or employment of, the person.
Maximum penalty—200 penalty units.
If the person complies with the licensing requirement by applying for a key monitoring employee’s licence but the commissioner refuses to grant the application—
on receipt by the person of notice of the refusal—the person must stop being a key officer of the licensed monitoring operator; and
on receipt by the operator of notice of the refusal—the operator must end the association with, or employment of, the person.
Maximum penalty—200 penalty units.
Subsections (5) and (6) (b) apply to the licensed monitoring operator despite another Act or law or any award or agreement of an industrial nature.
A licensed monitoring operator does not incur any liability because the operator ends an association with, or the employment of, a person under this section.
