### sec.109C Purchase of operating authority at authorised sale
A person must not purchase an operating authority unless—
the person is a category 1 licensee and purchases the operating authority at an authorised sale; and
the person has, for the category 1 licensed premises for which the operating authority is purchased, an approved number of gaming machines that is more than the licensee’s endorsed number of operating authorities; and
unless the authorised sale is conducted for the whole of the State—the category 1 licensed premises for which the operating authority is purchased are located in the authority region for which the authorised sale is conducted.
Maximum penalty—200 penalty units.
A person must not, for category 1 licensed premises, purchase more than the number of operating authorities equal to the difference between the approved number of gaming machines and the endorsed number of operating authorities for the licensed premises.

If an operating authority is transferred to a person by the operation of section 78 (5) or 79 (2) , the person is taken not to have purchased the operating authority.
