### sec.36 Sale or use of fossicking material in trade or commerce
This section applies to fossicking material collected under a licence.
A licensee must not—
in trade or commerce, sell the material; or
use the material in the production of something else for sale in trade or commerce.
Maximum penalty—400 penalty units.
However, this section does not apply to—
an occasional sale or use of fossicking material; or
a sale or use prescribed by regulation.
(sec.36-ssec.1) This section applies to fossicking material collected under a licence.
(sec.36-ssec.2) A licensee must not— in trade or commerce, sell the material; or use the material in the production of something else for sale in trade or commerce. Maximum penalty—400 penalty units.
