### sec.34 When fossicking materials become licensee’s property
If fossicking materials lawfully collected under a licence are the property of the State, the materials become the licensee’s property on collection.
However, the licensee must pay royalties on the fossicking materials.
Subsection (1) applies despite the following provisions—
Mineral Resources Act 1989 , section 8 .
Forestry Act 1959 , section 45
Water Act 2000 , section 279 .

(sec.34-ssec.1) If fossicking materials lawfully collected under a licence are the property of the State, the materials become the licensee’s property on collection.
(sec.34-ssec.2) However, the licensee must pay royalties on the fossicking materials.
