### sec.83A Particular decisions subject to review
A person who is dissatisfied with a reviewable decision made by a delegate of the chief executive exercising a delegated function of the chief executive under section 96B (the original decision maker ) may ask the chief executive to review the decision within 28 days after the person is notified of the decision.
The person reviewing the decision (the reviewer ) must be more senior than the person who made the decision.
The reviewer—
may—
confirm the original decision; or
make another decision and, for that purpose, has the same powers as the original decision maker; and
must give the applicant a statement of reasons for his or her decision.
In this section—
reviewable decision means—
a decision in relation to a permit under section 35 ;
a decision in relation to a licence under section 55 ;
a decision in relation to a permit, licence, lease, or other authority, or an agreement or contract, under section 56 ;
a decision in relation to a permit under section 73 (2) .

(sec.83A-ssec.2) The person reviewing the decision (the reviewer ) must be more senior than the person who made the decision.
(sec.83A-ssec.3) The reviewer— may— confirm the original decision; or make another decision and, for that purpose, has the same powers as the original decision maker; and must give the applicant a statement of reasons for his or her decision.
(sec.83A-ssec.4) In this section— reviewable decision means— a decision in relation to a permit under section 35 ; a decision in relation to a licence under section 55 ; a decision in relation to a permit, licence, lease, or other authority, or an agreement or contract, under section 56 ; a decision in relation to a permit under section 73 (2) .
- (a) may— (i) confirm the original decision; or (ii) make another decision and, for that purpose, has the same powers as the original decision maker; and
- (i) confirm the original decision; or

- (b) must give the applicant a statement of reasons for his or her decision.
