### sec.61TL Registrar of titles may prepare and register caveat
The registrar of titles may prepare and register a caveat over a plantation licence in favour of a person.
The registrar of titles may act under subsection (1) to prevent a dealing with a plantation licence that may prejudice—
the Commonwealth, a State or a relevant local government; or
a person because of—
misdescription of the plantation licence; or
fraud or forgery; or
a person, other than a person mentioned in any of paragraphs (a) or (b) , who has an interest in the plantation licence.
Also, the registrar of titles may act under subsection (1) to prevent a dealing with a plantation licence—
if the plantation licence is to be cancelled or terminated; or
to give effect to an order of a court of competent jurisdiction directed to the registrar.
Subsection (2) (c) applies only if the registrar of titles is satisfied, because of the nature or urgency of particular circumstances, there is no practicable alternative to registering the caveat.
In this section—
dealing , with a plantation licence, does not include registering a document to cancel or terminate a plantation licence.
relevant local government means the local government in whose local government area the licence area for the plantation licence or plantation sublicence is situated.

(sec.61TL-ssec.1) The registrar of titles may prepare and register a caveat over a plantation licence in favour of a person.
(sec.61TL-ssec.2) The registrar of titles may act under subsection (1) to prevent a dealing with a plantation licence that may prejudice— the Commonwealth, a State or a relevant local government; or a person because of— misdescription of the plantation licence; or fraud or forgery; or a person, other than a person mentioned in any of paragraphs (a) or (b) , who has an interest in the plantation licence.
(sec.61TL-ssec.3) Also, the registrar of titles may act under subsection (1) to prevent a dealing with a plantation licence— if the plantation licence is to be cancelled or terminated; or to give effect to an order of a court of competent jurisdiction directed to the registrar.
(sec.61TL-ssec.4) Subsection (2) (c) applies only if the registrar of titles is satisfied, because of the nature or urgency of particular circumstances, there is no practicable alternative to registering the caveat.
(sec.61TL-ssec.5) In this section— dealing , with a plantation licence, does not include registering a document to cancel or terminate a plantation licence. relevant local government means the local government in whose local government area the licence area for the plantation licence or plantation sublicence is situated.
- (a) the Commonwealth, a State or a relevant local government; or
- (b) a person because of— (i) misdescription of the plantation licence; or (ii) fraud or forgery; or
- (i) misdescription of the plantation licence; or
- (ii) fraud or forgery; or
- (c) a person, other than a person mentioned in any of paragraphs (a) or (b) , who has an interest in the plantation licence.
- (i) misdescription of the plantation licence; or

- (a) if the plantation licence is to be cancelled or terminated; or
- (b) to give effect to an order of a court of competent jurisdiction directed to the registrar.
