### sec.61RB Surrender of plantation licence or part of a plantation licence
A plantation licensee may apply to the Minister to surrender a plantation licence or part of a plantation licence.
An application for surrender of a plantation licence or part of a plantation licence must be accompanied by the written consent of—
each registered mortgagee of the plantation licence and any plantation sublicence of the affected area; and
any plantation sublicensee of the affected area.
The Minister may approve, or refuse, the application at the Minister’s discretion.
Without limiting the Minister’s discretion, the Minister may refuse the application until the affected area is rehabilitated to the Minister’s satisfaction.
If the Minister approves the application, the plantation licensee must lodge with the registrar of titles—
a surrender of a plantation licence; and
the written consent of all persons with a registered interest in the plantation licence.

In this section—
affected area means—
if the application relates to the surrender of a plantation licence—the licence area for the plantation licence; or
if the application relates to the surrender of part of a plantation licence—the part of the licence area for the plantation licence that will be removed from the licence area if the application is approved.

(sec.61RB-ssec.1) A plantation licensee may apply to the Minister to surrender a plantation licence or part of a plantation licence.
(sec.61RB-ssec.2) An application for surrender of a plantation licence or part of a plantation licence must be accompanied by the written consent of— each registered mortgagee of the plantation licence and any plantation sublicence of the affected area; and any plantation sublicensee of the affected area.
(sec.61RB-ssec.3) The Minister may approve, or refuse, the application at the Minister’s discretion.
(sec.61RB-ssec.4) Without limiting the Minister’s discretion, the Minister may refuse the application until the affected area is rehabilitated to the Minister’s satisfaction.
(sec.61RB-ssec.5) If the Minister approves the application, the plantation licensee must lodge with the registrar of titles— a surrender of a plantation licence; and the written consent of all persons with a registered interest in the plantation licence. - (a) each registered mortgagee of the plantation licence and any plantation sublicence of the affected area; and
