### sec.45A Owner of quarry material A lessee is to be taken to be the owner of quarry material in respect of a lease granted under the repealed Land Act 1962— on an application, under the repealed Land Act 1962 , section 139 received before 5 February 1990; or on an application, under the repealed Land Act 1962 , section 191 received before— 5 February 1990; or 3 October 1991, in respect of a lease issued or a lease converted from a special lease issued— under the repealed Land Act 1962 and under an arrangement under the repealed Industrial Development Act 1963 , section 9 ; or before the commencement of the repealed Industrial Development Act 1963— under a recommendation of the Minister administering industrial development; or on an application, under the repealed Land Act 1962 , section 207 received before— 5 February 1990; or 3 October 1991, in respect of a lease issued— under the repealed Land Act 1962 and under an arrangement under the repealed Industrial Development Act 1963 , section 9 ; or before the commencement of the repealed Industrial Development Act 1963 —under a recommendation of the Minister administering industrial development; or subject to a condition relating to the freeholding of the lease. s 45A ins 1991 No. 83 s 92 amd 2001 No. 57 s 3 sch ; 2012 No. 43 s 221 sch 1 - (a) on an application, under the repealed Land Act 1962 , section 139 received before 5 February 1990; or - (b) on an application, under the repealed Land Act 1962 , section 191 received before— (i) 5 February 1990; or (ii) 3 October 1991, in respect of a lease issued or a lease converted from a special lease issued— (A) under the repealed Land Act 1962 and under an arrangement under the repealed Industrial Development Act 1963 , section 9 ; or (ii) 3 October 1991, in respect of a lease issued— (A) under the repealed Land Act 1962 and under an arrangement under the repealed Industrial Development Act 1963 , section 9 ; or (B) before the commencement of the repealed Industrial Development Act 1963 —under a recommendation of the Minister administering industrial development; or (C) subject to a condition relating to the freeholding of the lease. - (i) 5 February 1990; or - (ii) 3 October 1991, in respect of a lease issued— (A) under the repealed Land Act 1962 and under an arrangement under the repealed Industrial Development Act 1963 , section 9 ; or (B) before the commencement of the repealed Industrial Development Act 1963 —under a recommendation of the Minister administering industrial development; or (C) subject to a condition relating to the freeholding of the lease. - (A) under the repealed Land Act 1962 and under an arrangement under the repealed Industrial Development Act 1963 , section 9 ; or - (B) before the commencement of the repealed Industrial Development Act 1963 —under a recommendation of the Minister administering industrial development; or - (C) subject to a condition relating to the freeholding of the lease. - (i) 5 February 1990;
