What it does
The Federal Court and Federal Circuit and Family Court Regulations 2022 is a Commonwealth legislative instrument that prescribes fees and related procedural matters for two federal courts: the Federal Court of Australia and the Federal Circuit and Family Court of Australia (Division 2, the general civil jurisdiction court). The instrument is made under section 60 of the Federal Court of Australia Act 1976 and section 285 of the Federal Circuit and Family Court of Australia Act 2021 (section 1.02).
The instrument does not govern family law proceedings. Family Law Act proceedings in Division 2 have their own fee instrument, the Family Law (Fees) Regulations 2022 (section 2.01A note).
The instrument is the primary framework for access to federal court services. Its fee schedules directly affect how much a litigant pays to commence proceedings, attend hearings, obtain copies, use court-connected mediation, or request registry services. It also prescribes remuneration for jurors serving in Federal Court trials and deals with the jurisdiction of the courts in certain specific circumstances.
