What it does
The Fair Work (Transitional Provisions and Consequential Amendments) Regulations 2009 are the operational companion to the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009. Together, they managed the transition of Australia's industrial relations framework from the Workplace Relations Act 1996 (WR Act) to the Fair Work Act 2009 (FW Act), with effect from 1 July 2009 (the WR Act repeal day).
The Regulations provide the detailed rules for how existing instruments under the WR Act continued to operate after the WR Act was repealed, how and when they were superseded by new FW Act instruments, and what obligations applied during transitional periods. They also deal with employee record obligations, award modernisation, and compliance during the transition.
The Regulations are made under the enabling Act and derive their legal force from it. They are organised in Parts that mirror the Schedules of the enabling Act, with each Part providing the detailed rules for the corresponding Schedule's transitional regime.
