### sec.21AI Application of sdiv 3
This subdivision applies to taking an affected child’s evidence—
for a summary trial for a relevant offence; and
for a trial on indictment for a relevant offence; and
for a committal proceeding for a relevant offence, if a magistrate or justices give a direction as mentioned in section 21AG (7) (b) that the child’s evidence is to be taken under this subdivision.
However, this subdivision does not apply to an affected child who is a witness for the defence.
Subsection (1) applies to a proceeding whether or not the proceeding also relates to offences other than the relevant offence.
