### sec.172 Application of s 94A to sexual offences charged before s 162 commencement Section 94A applies in relation to a proceeding for a sexual offence charged against the defendant before the section 162 commencement. Subsection (1) is taken to have applied from the section 162 commencement. To remove any doubt, it is declared that this section applies in addition to section 162. In this section— section 162 commencement means the commencement of section 162. Section 162 commenced on 23 September 2024. s 172 ins 2025 No. 7 s 40 (sec.172-ssec.1) Section 94A applies in relation to a proceeding for a sexual offence charged against the defendant before the section 162 commencement. (sec.172-ssec.2) Subsection (1) is taken to have applied from the section 162 commencement. (sec.172-ssec.3) To remove any doubt, it is declared that this section applies in addition to section 162. (sec.172-ssec.4) In this section— section 162 commencement means the commencement of section 162. Section 162 commenced on 23 September 2024.
