### sec.40 Release of water or waste to wetlands for treatment
This section applies to the administering authority for making an environmental management decision relating to an activity that involves, or may involve, the release of water or waste to a wetland for treatment.
The administering authority must refuse to grant the application if the authority considers that, because of the activity—
the wetland may be destroyed or reduced in size; or
the biological integrity of the wetland may not be maintained.
In this section—
biological integrity , of a wetland, means the ability of the wetland to support and maintain a balanced, integrative, adaptive community of organisms having a species composition, diversity and functional organisation comparable to that of the natural habitat of the locality in which the wetland is located.
(sec.40-ssec.1) This section applies to the administering authority for making an environmental management decision relating to an activity that involves, or may involve, the release of water or waste to a wetland for treatment.
(sec.40-ssec.2) The administering authority must refuse to grant the application if the authority considers that, because of the activity— the wetland may be destroyed or reduced in size; or the biological integrity of the wetland may not be maintained.
(sec.40-ssec.3) In this section— biological integrity , of a wetland, means the ability of the wetland to support and maintain a balanced, integrative, adaptive community of organisms having a species composition, diversity and functional organisation comparable to that of the natural habitat of the locality in which the wetland is located.
- (a) the wetland may be destroyed or reduced in size; or
- (b) the biological integrity of the wetland may not be maintained.
