### sec.223 Continuing particular activities related to mineral and bulk material handling This section applies to a person if— before the commencement, the person had carried out an activity that was not a prescribed ERA; and on the commencement, the activity became a prescribed ERA under new schedule 2, section 50; and after the commencement, the person continues to carry out the activity. For 1 year after the commencement, the activity carried out by the person continues to be an activity that is not a prescribed ERA. s 223 ins 2020 SL No. 225 s 6 (sec.223-ssec.1) This section applies to a person if— before the commencement, the person had carried out an activity that was not a prescribed ERA; and on the commencement, the activity became a prescribed ERA under new schedule 2, section 50; and after the commencement, the person continues to carry out the activity. (sec.223-ssec.2) For 1 year after the commencement, the activity carried out by the person continues to be an activity that is not a prescribed ERA. - (a) before the commencement, the person had carried out an activity that was not a prescribed ERA; and - (b) on the commencement, the activity became a prescribed ERA under new schedule 2, section 50; and - (c) after the commencement, the person continues to carry out the activity.
