### sec.166 Documents for eligibility for payment of a reduced annual fee
For section 165 (1) (d) , the holder of an environmental authority must give the chief executive each of the following documents—
if the holder has an approved EMS, other than a prescribed approved EMS—a statutory declaration, completed by a suitably qualified person, verifying that—
each relevant activity carried out under the authority in the previous year has been carried out in accordance with an environmental management system that a conformity assessment body has certified as conforming to AS/NZS ISO 14001:2016 ‘Environmental management systems–Requirements with guidance for use’; and
the holder is complying with the conditions of the authority;
if the holder has a prescribed approved EMS—a statutory declaration, completed by the holder, verifying that—
each relevant activity carried out under the authority in the previous year has been carried out in accordance with the National Feedlot Accreditation Scheme Rules published in September 2018 by AUS-MEAT Limited ABN 44 082 528 881; and
the holder is complying with the conditions of the authority;
if the holder is the holder of a relevant resource environmental authority and the holder is currently carrying out rehabilitation of the land that is the subject of the environmental authority—a statutory declaration, completed by the holder, verifying that—
the holder has stopped extracting the resource that is the subject of the environmental authority and does not intend to recommence extracting the resource; and
the holder is currently carrying out rehabilitation of the land that is the subject of the environmental authority;
the other documents and information stated in the annual notice.
In this section—
prescribed approved EMS means the National Feedlot Accreditation Scheme Rules published in September 2018 by AUS-MEAT Limited ABN 44 082 528 881.
(sec.166-ssec.1) For section 165 (1) (d) , the holder of an environmental authority must give the chief executive each of the following documents— if the holder has an approved EMS, other than a prescribed approved EMS—a statutory declaration, completed by a suitably qualified person, verifying that— each relevant activity carried out under the authority in the previous year has been carried out in accordance with an environmental management system that a conformity assessment body has certified as conforming to AS/NZS ISO 14001:2016 ‘Environmental management systems–Requirements with guidance for use’; and the holder is complying with the conditions of the authority; if the holder has a prescribed approved EMS—a statutory declaration, completed by the holder, verifying that— each relevant activity carried out under the authority in the previous year has been carried out in accordance with the National Feedlot Accreditation Scheme Rules published in September 2018 by AUS-MEAT Limited ABN 44 082 528 881; and the holder is complying with the conditions of the authority; if the holder is the holder of a relevant resource environmental authority and the holder is currently carrying out rehabilitation of the land that is the subject of the environmental authority—a statutory declaration, completed by the holder, verifying that— the holder has stopped extracting the resource that is the subject of the environmental authority and does not intend to recommence extracting the resource; and the holder is currently carrying out rehabilitation of the land that is the subject of the environmental authority; the other documents and information stated in the annual notice.
(sec.166-ssec.2) In this section— prescribed approved EMS means the National Feedlot Accreditation Scheme Rules published in September 2018 by AUS-MEAT Limited ABN 44 082 528 881.
- (a) if the holder has an approved EMS, other than a prescribed approved EMS—a statutory declaration, completed by a suitably qualified person, verifying that— (i) each relevant activity carried out under the authority in the previous year has been carried out in accordance with an environmental management system that a conformity assessment body has certified as conforming to AS/NZS ISO 14001:2016 ‘Environmental management systems–Requirements with guidance for use’; and (ii) the holder is complying with the conditions of the authority;
- (i) each relevant activity carried out under the authority in the previous year has been carried out in accordance with an environmental management system that a conformity assessment body has certified as conforming to AS/NZS ISO 14001:2016 ‘Environmental management systems–Requirements with guidance for use’; and
- (ii) the holder is complying with the conditions of the authority;
- (b) if the holder has a prescribed approved EMS—a statutory declaration, completed by the holder, verifying that— (i) each relevant activity carried out under the authority in the previous year has been carried out in accordance with the National Feedlot Accreditation Scheme Rules published in September 2018 by AUS-MEAT Limited ABN 44 082 528 881; and (ii) the holder is complying with the conditions of the authority;
- (i) each relevant activity carried out under the authority in the previous year has been carried out in accordance with the National Feedlot Accreditation Scheme Rules published in September 2018 by AUS-MEAT Limited ABN 44 082 528 881; and
- (ii) the holder is complying with the conditions of the authority;
- (c) if the holder is the holder of a relevant resource environmental authority and the holder is currently carrying out rehabilitation of the land that is the subject of the environmental authority—a statutory declaration, completed by the holder, verifying that— (i) the holder has stopped extracting the resource that is the subject of the environmental authority and does not intend to recommence extracting the resource; and (ii) the holder is currently carrying out rehabilitation of the land that is the subject of the environmental authority;
- (i) the holder has stopped extracting the resource that is the subject of the environmental authority and does not intend to recommence extracting the resource; and
- (ii) the holder is currently carrying out rehabilitation of the land that is the subject of the environmental authority;
- (d) the other documents and information stated in the annual notice.
