### sec.130 Environmental nuisance The administration and enforcement of each of the following provisions is devolved to each local government for its local government area— section 440 of the Act ; section 443A of the Act . Subsection (1) applies in relation to an activity being carried on by a person unless the chief executive gives the local government a written notice stating the activity involves serious or material environmental harm. For section 516 (2) (b) of the Act , the chief executive may not delegate the power to give a written notice under subsection (2) . s 130 amd 2024 Act No. 30 s 55 (sec.130-ssec.1) The administration and enforcement of each of the following provisions is devolved to each local government for its local government area— section 440 of the Act ; section 443A of the Act .
