### sec.494 Indictable and summary offences An offence against this Act for which the maximum penalty of imprisonment is 2 years or more is an indictable offence. An indictable offence against this Act is— for an offence for which the maximum penalty of imprisonment is 5 or more years—a crime; or otherwise—a misdemeanour. Any other offence against this Act is a summary offence. s 494 amd 2003 No. 96 s 28 sch (sec.494-ssec.1) An offence against this Act for which the maximum penalty of imprisonment is 2 years or more is an indictable offence. (sec.494-ssec.1A) An indictable offence against this Act is— for an offence for which the maximum penalty of imprisonment is 5 or more years—a crime; or otherwise—a misdemeanour. (sec.494-ssec.2) Any other offence against this Act is a summary offence. - (a) for an offence for which the maximum penalty of imprisonment is 5 or more years—a crime; or - (b) otherwise—a misdemeanour.
