### sec.339 Deciding application The administering authority must decide that an application for the issue of a transitional environmental program— be approved with or without the imposition of conditions on the program; or be refused. If the administering authority approves the application, the administering authority— must impose any conditions on the transitional environmental program the authority is required to impose under a regulatory requirement; and may impose a condition on the program requiring the holder to give an amount of financial assurance as security for compliance with the program and any conditions of the program; and may impose any other conditions on the program the administering authority considers appropriate. s 339 amd 2002 No. 45 s 3 (2) sch ; 2007 No. 56 s 6 sch sub 2011 No. 6 s 73 amd 2012 No. 16 s 20 sub 2023 No. 6 s 69 (sec.339-ssec.1) The administering authority must decide that an application for the issue of a transitional environmental program— be approved with or without the imposition of conditions on the program; or be refused.
